GoPro Violates The Patent of The Polaroid Cube Camera?

C&A Marketing Inc., the exclusive maker of Polaroid-branded cameras filled a lawsuit against GoPro on Tuesday in the U.S District Court in Newark, New Jersey. They are suing GoPro Inc., for the Hero4 Session, because of its similarity with Polaroid Cube camera design.

Whether Gopro Violates The Patent of The Polaroid Cube Camera?

If we see these cameras – the Hero4 Session and the Polaroid Cube – we may agree that both look alike. Hero4 Session has a similar appearance with the Cube. However, the Hero4 Session has the higher price than the Cube, starting from $299 with a higher resolution and a better frame rate, while the Cube retails for $99 and $150. Moreover, The Session does not need a case to be waterproof, while the Cube needs it to survive a dip in the pool.

According to GoPro CEO, Nick Woodman, they worked on the Hero4 Session for three years.

They also said the Session’s patents from the European Union patents and a U.S patent for the plastic case, were issued in March, and they have applied for the other U.S patent last year. Meanwhile, the Cube was released in August 2014 and obtained the patent in May 2015, while Hero4 Session was released 2 months after it.

Now, both companies are waiting for the federal jury to determine whether GoPro violates the patent of the Polaroid Cube camera.
